    You can't add axiom to the baby since he's not a foundation horse, and as long as Preacher has babies on the ground you can not add anything new to him as he is no longer modifiable, so at this point neither horse you are showing is viable for Axiom. None of the Axioms are currently in the RGS as well so it would be impossible to add at this time (RGS changed on the 15th) too.

    That said, if someone puts Axiom on a foundation horse you own while you own it, you are the one who gets the license for it.

    Could I add it to him since he's a foundation horse, and hasn't had any foals?

    Yes, he would be an option to add Axiom to when it next comes up in the RGS sales since he has no babies. As the axiom genes are not currently in the RGS you'll have to wait for them to show up in the rotation again though so by then you may have used him or found a different horse you might want them on. Genes from the RGS can be added to any foundation horse that has no babies/family.
